Summary
Repairing, maintaining, or changing any encroachment in the San Marcos right-of-way, or performing any encroachment work in a street or sidewalk, requires a permit issued by the Director, so property owners cannot do such work without authorization.
Except as provided by this Chapter, no Person shall place, repair, maintain, or change any permanent and/or temporary Encroachment, nor perform Encroachment Work, within the City unless authorized pursuant to a Permit issued by the Director.

San Marcos Municipal Code section 14.21.020 requires a permit from the Director not only to place, but also to repair, maintain, or change any permanent or temporary encroachment, and to perform any encroachment work within the city. A property owner repairing a driveway approach, sidewalk feature, or other structure in the public right-of-way must therefore obtain an encroachment permit first.
