Summary

In the City of Sonoma, the owner of any building, lot or premises fronting a public sidewalk is legally responsible for keeping it in repair, including damage caused by tree roots. An owner who lets a sidewalk stay defective or dangerous can be liable for negligence to anyone injured because of it.

It is unlawful for any person, firm or corporation owning any building, lot or premises in the city fronting on any portion of an improved street or way where a sidewalk is laid to allow any portion of such sidewalk in front of such building, lot, or premises to be out of repair, or to become, be or remain defective, or to become, be or remain dangerous to the users thereof for any reason. Such person, firm or corporation must at all times keep each such sidewalk in such condition that it will not endanger persons or property passing thereon, will not interfere with public convenience in the use thereof, or be or remain an obstruction or impediment to normal, customary and usual pedestrian or vehicular traffic. Such property owner shall be responsible for all maintenance and repairs, including that required to repair damage caused by tree roots, needed to keep the sidewalk improvements in a safe condition. Such property owner shall have a duty to members of the public to keep sidewalk improvements in a reasonably safe condition and shall be liable for negligence to any person suffering damage due, in whole or in part, to the owner's failure to perform this duty.

Full Breakdown

12 Sidewalk and Driveway Construction, makes it unlawful for any owner of a building, lot or premises fronting an improved street where a sidewalk exists to let any part of that sidewalk go out of repair, become defective, or become dangerous to users for any reason. The owner must at all times keep the sidewalk in a condition that will not endanger people or property, will not interfere with public use, and will not obstruct normal pedestrian or vehicular traffic. The section specifically extends this duty to damage caused by tree roots, meaning root heave from a parkway or private tree does not shift responsibility away from the property owner.

The code goes further and creates a civil duty running to the public: the property owner owes a duty to members of the public to keep the sidewalk reasonably safe and can be held liable for negligence to anyone who suffers damage because the owner failed that duty, in whole or in part. 130 separately adopts California Streets and Highways Code §§ 5600-5630 and 5870-5894 as the governing procedure, and defines 'sidewalk' for this chapter the same way the state code does, extending it to driveways and driveway approaches as well. 090.

Violations & Fines

Violating any provision of Chapter 12.12, including the sidewalk repair duty in SMC 12.12.110, is a misdemeanor punishable as set out in Chapter 1.12 SMC (SMC 12.12.160). Beyond criminal exposure, a noncompliant owner faces civil negligence liability to any member of the public injured by the disrepair, as the section itself states.
