Section 9.74.110(G), Digital Advertising Displays, only permits digital signs within the Regional Commercial (C-R), General Commercial (C-G) and Village Commercial (C-V) zoning designations, on a developed site with at least 100 feet of lot frontage along I-15 or a Major Divided Arterial, Major Divided Parkway or Major Road identified in the Circulation Element. A single-tenant building or site may have only one digital sign, and none may sit within 150 feet of a residential unit or district. The digital face must be accessory to and architecturally integrated with a non-digital freestanding or wall sign, may occupy no more than 80 percent of the sign area or 30 square feet, whichever is less (a limit that does not apply to billboards fronting the freeway), and a freestanding digital face cannot exceed eight feet in height except on signs fronting I-15. Operating standards bar changing the display more than once every five seconds, cap slide transitions at one second, prohibit scrolling or animated text on signs visible from a public right-of-way, and require a light meter that auto-adjusts brightness to ambient conditions.
Freestanding billboards, digital or not, are governed separately under § 9.74.187 and require a Conditional Use Permit. They are limited to the C-R zone, may sit on any parcel within 660 feet of Interstate 15, and must maintain 2,500 feet of separation from any other billboard or Civic Gateway Sign. Maximum height is 35 feet, the face may be up to 25 feet tall by 50 feet wide, and total sign area is capped at 500 square feet; two-sided and V-shaped faces are allowed. Applicants must submit a current State Outdoor Advertising Permit, when the state requires one, before the Town issues a Building Permit.
Violations & Fines
Enforcement runs through § 9.74.230: the Building Official can issue a stop-work order on a noncompliant digital display, and the Director can revoke the sign permit. An illegal digital sign or billboard is declared a public nuisance subject to Town removal, with processing, removal and storage costs billed to the permittee, sign owner or property owner, on top of any Municipal Code penalty.
