Summary

Digital billboards in Eugene's highway commercial and employment zones must sit at least 1,200 feet from another digital billboard facing the same direction under EC 9.6675(7). Messages can change no more than once every 8 seconds, with an instantaneous transition and no animation. The code also requires a malfunction failsafe that freezes, blacks out or shuts off the display.

(7) Digital Billboards. In addition to the standards in EC 9.6675(6), Digital Billboards shall be subject to the following standards. Where standards conflict, the standards for Digital Billboards in this subsection (7) shall control: (a) Minimum spacing between digital billboards facing the same direction shall be 1,200 feet. For purposes of this subsection, "facing the same direction" means oriented within 60 degrees of the sign face of another digital billboard. The distance between digital billboards shall be measured along the centerline of the street designated to be a location for digital billboards. (b) The change from one message to another message shall be no more frequent than once every 8 seconds. (c) The change from one message to another message shall be instantaneous. (d) Animation is not allowed. (h) Cutouts are not allowed.

Full Breakdown

Eugene allows digital billboards only within the highway commercial sign standards area defined at EC 9.6675(1), covering frontage along streets such as Highway 99 North, Beltline Road, Franklin Boulevard and the south side of I-5, plus a matching provision for employment and industrial zones at EC 9.6680. Under EC 9.6675(7), digital billboards must be spaced at least 1,200 feet from another digital billboard oriented within 60 degrees of the same direction, with the distance measured along the centerline of the designated street. Message content can change no more than once every 8 seconds, the transition must be instantaneous rather than a fade or wipe, and animation is prohibited outright. Cutouts, the supplemental sign elements otherwise allowed on standard billboards under EC 9.6675(6)(d), are not permitted on digital faces.

The code also builds in a safety backstop: if a digital billboard malfunctions, EC 9.6675(7)(g) requires the display to either freeze on one static image, go to a full black screen, or shut off entirely, rather than showing a corrupted or flashing image. A legal nonconforming billboard can be removed and replaced with a digital billboard without changing its location, area or height, but only if the building permit is issued within 365 days of the first day of demolition and the replacement does not exceed 300 square feet, per EC 9.6675(7)(i). Every digital billboard permit still runs through the general sign permit process at EC 9.6625, which the building and permit services manager grants or denies within 21 calendar days of a complete application under EC 9.6630(3).

Violations & Fines

Building a digital billboard without an approved sign permit, or operating one that doesn't meet the spacing, timing or brightness standards in EC 9.6675(7), violates the sign standards and the land use code generally. EC 9.0275(2) sets a fine of up to $1,000 per day the violation continues, plus up to 100 days in jail. The building and permit services manager can also invalidate the permit and order the sign abated as a public nuisance under EC 9.6625(3).

Frequently Asked Questions

How far apart must Eugene's digital billboards be?
EC 9.6675(7)(a) requires at least 1,200 feet between two digital billboards that face the same direction, meaning their sign faces are oriented within 60 degrees of each other. The distance is measured along the centerline of the street designated for billboard placement, not as the crow flies, so a billboard just off that street can sit closer than 1,200 feet from a neighboring one facing a different corridor.
Can a digital billboard in Eugene scroll or animate its message?
No. EC 9.6675(7)(d) prohibits animation outright, and subsection (c) requires the transition from one message to the next to be instantaneous rather than a fade, wipe or dissolve. Messages also cannot change more than once every 8 seconds, so the display has to hold a static image for at least that long before switching.
What happens if a digital billboard in Eugene malfunctions?
EC 9.6675(7)(g) requires the sign to be designed so a malfunction results in the display freezing on one static position, showing a full black screen, or shutting off completely. A billboard that instead flashes, scrambles or otherwise malfunctions visibly is out of compliance and subject to the same enforcement as any other sign standards violation.
