Full Breakdown
Section 34-754 opens by stating that the listed signs and sign types are prohibited within the city limits and shall not be erected, operated or placed on any property. Four entries decide the digital billboard question: (b) animated signs, (e) billboards and off-site commercial signs, (g) flashing signs and (k) holographic display signs.
The definitions in § 34-300 close the loopholes. A billboard is an advertising sign or other commercial sign which directs attention to a business, commodity, service, entertainment or attraction sold, offered or existing elsewhere than upon the same lot where the sign is displayed. An animated sign includes action, motion or color changes, or the optical illusion of them, and expressly covers any type of screen using animated or scrolling displays, such as an LED (light emitting diode) screen or any other type of video display. A flashing sign is any illuminated sign whose artificial light is not maintained stationary or constant in intensity and color. The code also defines an LED display sign as any sign using LED technology to produce an illuminated image, picture or message, whether moving or stationary, and a holographic display sign as an advertising display creating a three-dimensional image through projection, OLED or similar technology.
What is allowed is narrower. Section 34-755(x)(1) lets a changeable copy sign, manual or electronic (LED), be installed as part of a permitted monument sign or wall sign. It cannot exceed fifty (50) percent of the allowable area of the monument or wall sign, cannot exceed ten (10) feet in height on a single occupant monument sign or sixteen (16) feet on a multiple occupant monument sign, and cannot be installed higher than the wall of the building. The copy cannot be changed more than once every twenty-four (24) hours, and it can be internally illuminated.
A lawfully existing permanent sign structure of a prohibited type is deemed a nonconforming sign under § 34-760. Section 34-759(a) provides that no sign permit shall be issued for the erection of a prohibited sign.
Violations & Fines
Section 34-759(a) bars the city from issuing a sign permit for a prohibited sign, so a billboard or an animated, flashing or holographic display cannot be permitted. Under § 34-762, penalties for violating the sign division follow § 34-1204 but are limited to civil penalties only and never extend to any criminal penalty, including incarceration. Lawfully existing prohibited permanent signs become nonconforming under § 34-760.
