Summary
A new digital or electronic off-premises billboard cannot go up anywhere within the City of Owensboro. Municipal Code Section 18-10 bans all new outdoor, commercial off-premises signs citywide, with no exception for electronic or changeable-copy technology, and directs the city to fine violators and remove any sign built in defiance of the ban.
Sec. 18-10. - New off-premises commercial billboards prohibited. ... (c)Off-Premises Commercial Signs; General Prohibition. From and after the effective date of the ordinance from which this section derives, all new outdoor, commercial off-premises signs are prohibited within the corporate limits of the city, and no sign permits shall be issued for outdoor, off-premises signs within the scope of this section; provided, however, this section shall not prohibit any sign, display or device that contains, in lieu of any other copy, any otherwise lawful noncommercial message that does not direct attention to a business operated for profit, or to a commodity or service for sale, and that otherwise complies with the requirements of the law. ... (e)Enforcement; Penalties for Violations. Any outdoor, off-premises sign constructed, erected or displayed in violation of this section is hereby declared to be a public nuisance and may be removed by the city at the owner's expense. Any person, firm, corporation or other legal entity who violates the provisions of this section shall be fined not less than fifty dollars ($50.00) nor more than one hundred dollars ($100.00) for each day that the violation occurs.
Full Breakdown
Owensboro's electronic changeable copy rules in the zoning ordinance's Article IX, Sections 9-4(a)(5) and 9-5(a)(5), only apply to on-premises business, institution and farm signs in business, industrial and professional zones; they say nothing about billboards, because billboards are off-premises signs and Owensboro's own Municipal Code forecloses them before the zoning ordinance's technology rules ever come into play. Section 18-10, adopted by Ordinance No. 53-89 in 1989 and amended by Ordinance No. 28-2007, declares that the number of commercial billboards in the city is 'excessive and unduly distracting to motorists and pedestrians' and bans 'all new outdoor, commercial off-premises signs' within the corporate limits, with no permit to be issued for any such sign.
A digital or electronic billboard, whether static-image or full-motion, is still an off-premises commercial sign under that definition and gets no separate carve-out for its display technology. The ban does not reach signs already lawfully in place when the ordinance took effect, or ones that are altered, replaced or repaired without being enlarged, and it does not apply to noncommercial messages or to consolidated shopping center signs meeting the criteria in zoning ordinance Section 9-4(g). Any new off-premises sign built in violation is declared a public nuisance that the city may remove at the owner's expense, and Section 18-10(e) fines the responsible party $50 to $100 for every day the violation continues, separate from the general Zoning Ordinance penalty in Section 5.6 that governs other Article IX sign violations.
Violations & Fines
Erecting a new digital, electronic or any other off-premises commercial sign inside the city is a nuisance under Section 18-10(c) and (e). The city can remove the sign at the owner's expense, and the person, firm or corporation responsible is fined not less than $50 nor more than $100 for each day the violation continues, a penalty that runs independently of the standard Zoning Ordinance fine in Section 5.6.
