No off-premises signs shall be erected after October 16, 2003, except that upgrades, replacements, or modifications to existing signs may be permitted as authorized by this section for condemnation settlement proceedings addressing replacement of existing nonconforming off-premise signs or billboards and new digital or traditional billboards may replace existing nonconforming off-premise signs or billboards where the county has made a legal settlement or agreed to do so in the course of condemnation and/or eminent domain proceedings. A digital off-premise sign face approved pursuant to a condemnation settlement agreement may be relocated to an existing nonconforming off-premise sign structure at the sole discretion of the board. Full Breakdown
Brevard County Code § 62-3309(a)(11) bars any new off-premises sign, an advertising structure for a business, product, or service not located on that parcel, the category that covers freeway billboards, from being erected anywhere in unincorporated Brevard after October 16, 2003. The only exception is upgrading, replacing, or modifying an existing nonconforming billboard, and only where the county reached or agreed to a legal settlement in a condemnation or eminent domain proceeding; that can include converting an old panel to a digital face under § 62-3306(d). Outside that narrow settlement path, the county issues no new billboard permits, full stop.
Violations & Fines
Code enforcement or the building division cites illegally erected or maintained off-premises signs under § 62-3318(a)(4): each day a violating billboard stays up is a separate offense, punishable by $500 per day until it's removed.
