Garage sales are a permitted accessory residential use in unincorporated San Diego County under Section 6156.gg of the Zoning Ordinance (Ordinance 9690). The sale of household articles or personal possessions incidentally accumulated during normal residential use of a property is allowed subject to restrictions: such sales may not exceed three consecutive days in duration; no more than four sales may be held during any calendar year; no sale of vehicles (other than bicycles), industrial or commercial equipment, or items purchased for resale is permitted; and the sale of items belonging to neighbors who do not reside on the property is allowed. The County does not have a sign rule written specifically for garage sales. Signs are instead regulated by the Zoning Ordinance's On-Premise Sign Regulations (commencing at Section 6250) and Off-Premise Sign Regulations (commencing at Section 6200). Off-premise directional signs are limited to no larger than 4 square feet, are restricted to daylight hours, are limited to one per parcel (two on a corner lot) with the owner's permission, and are not allowed in the public right-of-way. Signs placed in the County road right-of-way are subject to the Department of Public Works community sign program and may be removed.
Holding garage sales beyond the three-day or four-per-year limits, or selling prohibited items, violates Section 6156.gg of the Zoning Ordinance. Off-premise signs placed in the public right-of-way may be removed. Enforcement under Section 7703 treats violations as a misdemeanor (up to six months and/or $1,000) or an infraction ($100/$200/$500), with each day a separate offense.
