Fort Myers no longer issues garage-sale signs and no longer requires homeowners to register a sale (Ordinance 3879 amending Chapter 66, Article II). Sign placement remains controlled by Chapter 126 (Signs) of the Land Development Code: temporary signs cannot be placed in any public right-of-way or attached to utility poles, traffic signs, trees, or fences. Off-premise garage-sale signs in the right-of-way may be removed immediately by code enforcement or the city engineer.
Under Fort Myers Ordinance No. 3879, which amended Chapter 66 (Sales), Article II (Garage Sales), homeowners are no longer required to register their garage sale with the City, and the City no longer issues garage-sale signs. The two-sales-per-calendar-year frequency cap remained in place under Chapter 66 Art. II. Sign placement remains governed by Chapter 126 (Signs) of the Land Development Code (Subpart B). Under Chapter 126, garage-sale signs are treated as temporary signs: they may be placed only on the private property where the sale is being conducted, with the property owner's permission, and may not be placed on any public property or in any public right-of-way (swales, medians, parkway strips, utility easements). The Chapter 126 prohibition extends to attaching signs to street lamp posts, traffic signs or signals, fire hydrants, trees, shrubs, fences, or utility poles. Off-premise directional signs are subject to immediate removal by Fort Myers Code Enforcement, the police department, or the city engineer, without notice to the property owner or sale operator. Signs must be removed promptly when the sale ends. Continuing violations of Chapter 66 (frequency cap) or Chapter 126 (placement) are processed through the Code Enforcement Division (1825 Hendry St., Suite 101; 239-321-7940) and adjudicated by the Special Magistrate under FS Chapter 162, with fines up to $250/day for first violation and $500/day for repeats under FS 162.09.
Signs in public right-of-way removed immediately without notice (Chapter 126). Other violations cited through Code Enforcement; Special Magistrate fines up to $250/day first, $500/day repeat (FS 162.09).
