Under Texas Election Code Section 259.002 and Texas Property Code Section 202.009, La Porte residents have the right to display political signs on their own property. The city cannot prohibit political signs on private property during election periods. HOAs are also restricted from banning political signs, though they may impose reasonable size and number limitations. Signs may generally be displayed beginning 90 days before an election and must be removed within 10 days after the election. The city's sign ordinance prohibits placing signs in public rights-of-way, on utility poles, or on traffic control devices. Signs must not obstruct visibility at intersections or create a traffic hazard. Political signs on private property do not require a permit. Signs placed in public rights-of-way may be removed by the city without notice. Violations of the sign ordinance may result in fines. HOAs that improperly prohibit political signs may face legal action under the Texas Property Code. Obstruction of traffic visibility can result in immediate sign removal.
