New Castle County UDC Article 6 treats political signs as temporary signs exempt from permitting when placed on private property with owner consent. Residential zones permit political signs up to 6 square feet; non-residential zones allow up to 32 sq ft. Signs must not be placed in DelDOT or county rights-of-way, on utility poles, or on public property β Delaware Code Title 17 Β§1110 authorizes removal of signs from state rights-of-way. Signs may not obstruct sight triangles at intersections or driveways. Removal is required within 7 days after the election to which they relate. Content-based regulation is limited under Reed v. Town of Gilbert (2015).
Signs in public right-of-way: removed by DelDOT or county without notice; no fine for first offense. Failure to remove post-election within 7 days: civil penalty $25 per sign per day. Oversized signs: correction notice.
