Texas Property Code Section 202.010 strongly protects homeowners from HOA restrictions on solar energy devices. HOAs cannot prohibit or restrict solar panel installation but may require aesthetic conformance: panels must not extend above the roofline or deviate from roof slope, must be silver/bronze/black in color, and ground-mounted systems cannot extend above the fence line. HOAs may require prior architectural approval but cannot deny a compliant application or charge fees exceeding $500 for review. HB 431 (effective May 29, 2025) expanded protections to include solar roof tiles.
HOA restrictions violating TX Property Code Section 202.010 are unenforceable. Homeowner may seek civil remedies.
