Overland Park, KS Solar Energy: HOA Restrictions (2026)

K.S.A. 58-4617(c) lets an association adopt rules establishing and enforcing construction and design criteria and aesthetic standards where the declaration so provides. Subsection (d) is the only display protection in the act, and it reaches the United States and Kansas flags and signs about candidates and ballot questions, not solar equipment. Chapter 58, Article 38 addresses restrictive covenants at K.S.A. 58-3820 for political yard signs and at 58-3821 and 58-3822 for transfer fee covenants, with no solar provision. What Kansas does provide is a voluntary tool: K.S.A. 58-3801 allows a written, recorded solar easement for exposure of a solar energy device. Legislative attempts to void solar covenants failed, most recently SB 144, which died in committee on April 10, 2026.
