Texas Property Code Section 202.010 makes void and unenforceable any HOA covenant that prohibits or restricts the installation of solar energy devices. HOAs retain limited authority to require panels not to extend higher than the roofline, to be in a specified color blending with the roof, to conform with installation patterns, or to be located in a less visible part of the lot β but only if the alternative does not increase installation cost by more than 10% or reduce energy production by more than 10%. The protection applies to single-family lots subject to deed restrictions throughout the state.
An HOA enforcing a void solar ban can be sued by the homeowner; courts may award injunctive relief, actual damages, and attorney's fees.
