Texas Property Code §202.010 strictly limits HOA authority to prohibit solar panels. HOAs cannot ban solar devices but may require architectural review for panel placement, provided the requirement does not reduce estimated energy production by more than 10%. Many Travis County lake-area HOAs have adopted solar-compliant guidelines after 202.010.
HOAs may require panels to conform with roof slope, be mounted below roofline when feasible, and be in the least visible location that does not reduce production by more than 10%. Ground-mount systems may be restricted to rear yards or screened from street view. HOAs must approve or deny solar applications within reasonable time — typically 60 days.
HOA violating 202.010: owner may sue for declaratory and injunctive relief plus attorney fees. Court may award statutory damages.
