Second, New Jersey provides significant pro-solar legal protection: the Solar Easements Act at N.J.S.A. 46:3-24 et seq. authorizes recordable solar easements between neighbors, and N.J.S.A. 45:5A-43 (the solar-rights statute, applicable to homeowner associations) prohibits an HOA from prohibiting or unreasonably restricting solar collectors on the unit owner's exclusive-use portion of the property, including the roof of a townhome under HOA control - although the HOA may impose reasonable aesthetic conditions. Edison's Chapter 37 contains no general prohibition on residential PV; setback and bulk standards apply to ground-mounted arrays as accessory structures, while rooftop arrays follow the principal-structure footprint.
Installing a PV system without UCC permits violates N.J.A.C. 5:23, exposing the homeowner and installer to stop-work orders, double permit fees on the retroactive application, denial of utility net-metering interconnection by PSE&G or Jersey Central Power and Light, and potential loss of NJ SREC-II / Successor Program incentive eligibility. HOA restrictions that exceed the reasonable-aesthetics limit in N.J.S.A. 45:5A-43 are unenforceable and may be challenged in Superior Court.
