The system must be kept properly maintained and free from hazards, including faulty wiring, loose fastenings, or any condition unsafe or detrimental to public health or safety (§ 155.4303.EE.3.c). Approval of a system does not entitle the owner to keep it free of shade from a neighbor's future construction or tree growth; the property owner is responsible for negotiating any solar easement with adjoining owners, and any such easement must be recorded with the Broward County Records Division with a copy submitted to the Development Services Director (§ 155.4303.EE.3.d).
Because of this, Development Services also weighs protection of solar access to an existing or approved system as a factor when it reviews a Tree Permit for relocating or replacing trees, under §§ 155.5204.D.2 and 155.5204.E.2 (§ 155.4303.EE.3.e). None of this waives the separate building permit required for the electrical and structural work of installing the array.
Violations & Fines
Installing or maintaining a system outside these standards is a code violation prosecuted through the city's Special Magistrate process under Chapter 37. Under § 37.10(D), fines top out at $1,000 per day for a first violation, $5,000 per day for a repeat violation, and up to $15,000 per violation if the Special Magistrate finds the violation irreparable or irreversible. Unpaid fines become a recorded lien on the property.
