Virginia Code Section 59.1-510 through 59.1-518 establishes the Telephone Privacy Protection Act, prohibiting telephone solicitations to numbers on the federal Do Not Call Registry. Solicitors must disclose identity, may not block caller ID, and cannot call before 8 AM or after 9 PM. The Office of the Attorney General enforces violations and may seek civil penalties. While door-to-door solicitation regulation is largely delegated to localities, telephone solicitation is governed uniformly by state and federal law.
Civil penalties up to $5,000 per violation, plus actual damages and attorney fees, may be awarded. The Attorney General may seek injunctive relief and additional penalties for willful or repeated violations.
