The ordinance applies to any person who goes from door to door or place to place for the purpose of selling, offering to sell, or taking orders for goods, merchandise, or services. This includes commercial sales representatives, home improvement contractors soliciting work, magazine subscription sellers, security system salespeople, pest control companies, and similar commercial canvassers. All commercial solicitors must complete a registration process with the Flower Mound Police Department and obtain an official solicitor identification badge before beginning any door-to-door activity within the town. The registration application requires submission of a valid government-issued photo identification, the legal name and physical address of the employing company or organization, a detailed description of the goods, services, or subscriptions being offered, the expected duration and geographic area of the solicitation campaign, and signed consent to a criminal background check conducted by the Police Department using state and national criminal databases. Applicants with felony convictions or misdemeanor convictions involving fraud, theft, burglary, identity theft, assault, or other violent offenses within the preceding five years may be denied a permit based on the Police Department's assessment of public safety risk. Denial decisions may be appealed through the town's administrative appeals process. Approved solicitors receive a town-issued identification badge that includes the individual's name, photograph, the name of the employing organization, the permit expiration date, and the Police Department's non-emergency phone number for residents to verify the solicitor's credentials. Solicitors must carry this badge on their person and display it prominently to any resident who requests to see it. Solicitation activity is restricted to the hours between 9 AM and sunset, Monday through Saturday. The sunset restriction means that permitted hours vary seasonally, extending later in summer months and ending earlier in winter. No solicitation of any kind is permitted on Sundays or recognized federal holidays. Solicitors must immediately and peacefully depart from any property where the resident asks them to leave, regardless of whether the conversation has been completed. Religious organizations conducting door-to-door outreach, political campaigns canvassing for candidates or ballot measures, and registered nonprofit charitable organizations soliciting donations or volunteers are exempt from the permit fee requirement under First Amendment protections. However, these exempt organizations must still register with the Police Department, comply with the permitted solicitation hours, and respect the town's no-solicitation registry and posted no-solicitation signage. The solicitor permit is valid for 30 days from the date of issuance and must be renewed for continued solicitation campaigns extending beyond that period. Permit holders who violate any provision of Chapter 62 may have their permits revoked by the Police Department.
Soliciting without a valid permit is a Class C misdemeanor with fines up to $500 per offense. Soliciting outside permitted hours, on Sundays, or at properties listed on the no-solicitation registry or displaying no-solicitation signs results in citation. Failure to carry and display the identification badge while soliciting is a separate violation. Continuing to solicit after being asked to leave a property constitutes criminal trespass under Texas Penal Code Section 30.05.
