Riverside Municipal Code Chapter 5.08 (Soliciting) regulates door-to-door commercial solicitation. Solicitors must register with the City, obtain a permit and ID card, and comply with hour and no-solicitation-sign restrictions. Non-commercial, religious, and political canvassing is protected by the First Amendment.
RMC Chapter 5.08 (Soliciting) requires any person engaged in door-to-door commercial solicitation in Riverside to obtain a City solicitor's permit through the Finance Department. The application includes the solicitor's identity, employer, goods/services to be sold, and a background-check disclosure. Applicants must also hold a Riverside business tax certificate under RMC Chapter 5.04. Solicitors must carry the City-issued ID/permit at all times and present it on request. State law adds: California Business & Professions Code § 17500 prohibits false or misleading representations, and the Federal Trade Commission Cooling-Off Rule (16 CFR § 429) gives consumers a three-business-day right to cancel any home-solicitation sale of $25 or more. California Civil Code §§ 1689.5-1689.14 (Home Solicitation Sales Act) requires written contracts and a clear three-day cancellation notice in the language of the sale. Per Supreme Court precedent (Watchtower Bible v. Stratton, 536 U.S. 150 (2002)), the City may not require a permit for non-commercial speech such as religious or political canvassing — Chapter 5.08 is therefore limited to commercial solicitors.
Violations of RMC Chapter 5.08 are misdemeanors or infractions under RMC § 1.16; first-offense infraction typically $100, second $200, third $500 within one year. Operating without a Riverside business license is a separate misdemeanor under RMC Chapter 5.04. Federal Cooling-Off Rule violations may be prosecuted by the FTC with civil penalties up to $51,744 per violation (16 CFR § 1.98, adjusted annually).
