Summary
Modesto Code of Ordinances § 4-8.01 requires a Police Chief-issued permit for any parade, march or procession on a public street, alley or park. Organizers must apply 15 to 60 days ahead, and the Chief can deny, reroute or reschedule a parade using six specific public-safety criteria set out in § 4-8.04.
It shall be unlawful for any person to hold, manage, conduct, aid, participate in, form, start or carry on, any parade, march, ceremony, show, exhibition, pageant, or procession of any kind or any other similar display, or cause or permit the same upon any public street, alley, park or any other public grounds in the City unless there has first been obtained from the Chief of Police a permit to do so, and said permit shall be carried by a person heading or leading said activity.
Official source re-checked September 7, 2026: no newer edition of the code had been published (publisher’s edition: Code of Ordinances: Supplement 71).
Full Breakdown
in 1960, requires anyone who wants to hold, manage or participate in organizing a parade, march, ceremony, show or procession on a public street, alley, park or other public ground to first obtain a permit from the Chief of Police, carried by whoever leads the event. 02 exempts funeral processions, students traveling to and from school activities under staff supervision, and government agencies acting within their own functions. 03, an applicant must file a verified application 15 to 60 days before the event date, listing the organizer, a responsible parade chairman, the date, route, start and end points, assembly locations and times, and the approximate number of people, animals and vehicles involved.
04 requires payment of a Council-set processing fee and lets the Chief approve the permit only after finding the parade will not seriously disrupt traffic, overextend police staffing, interfere with fire or ambulance access, obstruct emergency vehicles, risk injury or disorder, or serve solely to advertise a single business. 06, must mail a written denial with reasons within ten days. 08 lets the Chief instead offer an alternate date, time or route, which the applicant must accept in writing within two days. 10 requires the Chief to notify the Fire Chief, City Manager, Public Works Director, Parks Director, Community Development Director, the Postmaster and any affected transit or utility operator.
Violations & Fines
Holding an unpermitted parade, or joining or interfering with a permitted parade without the permittee's consent under § 4-8.11, is unlawful under this chapter and, absent a specific infraction designation, is punishable as a misdemeanor under the citywide penalty schedule in § 1-2.01: up to a $1,000 fine, up to one year in county jail, or both.
