Iowa City, IA Special Events & Permits: Sidewalk Dining & Cafés (2026)

Section 10-3-2 makes commercial use of a public sidewalk, including a sidewalk cafe, unlawful except as specifically authorized by chapter 3 of title 10. Section 10-3-3(A) confines sidewalk cafes to the central business zones (CB-2, CB-5, and CB-10) and the riverfront crossings district if the restaurant holds an alcohol license; restaurants without an alcohol license may operate a sidewalk cafe in other zones too, but the city manager may impose shorter hours and tighter limits there than the council's general policy allows. No one may operate a sidewalk cafe without executing a public right of way easement agreement under subsection B, applied for through the public works department on city forms under subsection C.

The city manager or designee must grant or deny the application within 30 days under subsection D, and a denial can be appealed to the city council using the same appeals process set for mobile vendors elsewhere in the chapter; the city retains the right to cap the total number of sidewalk cafes citywide. Subsection G fixes operating hours precisely: 7:00 AM to midnight in the central business zones and in the RFC-G zone through 10:00 PM, and in all other riverfront crossings zones 7:00 AM to 10:00 PM Sunday through Thursday but until midnight Friday and Saturday.

Food and beverages must be available throughout all hours of operation under subsection H, and a cafe cannot operate once the restaurant's kitchen has closed. A cafe serving alcohol must have an employee monitoring the area at all times alcohol is being consumed under subsection I, and amplified sound equipment is banned outright under subsection J. The easement can be terminated under subsection E for repeated liquor law violations, easement breaches, or a safety or nuisance hazard, with the cafe owner able to appeal termination to the council, and fees are set by council resolution under subsection L.
