Any restaurant, retail or café use wanting to put tables, shelves or other 'improvements' on a sidewalk or in a parking lane must apply to the Department of Transportation, which can require a layout sketch and at least two photographs of the proposed area. The permit is a revocable license personal to the business: it creates no vested property right for the permittee or the property owner, and the City retains free access to the right-of-way for maintenance. Permittees must carry general liability insurance naming the City as an additional insured, plus liquor liability coverage if alcohol is served, and must indemnify the City against claims arising from the encroachment.

The permit cannot be assigned without City approval, and any encroachment posing an immediate danger to life, safety or health can be removed without notice; abandonment for seven consecutive days triggers removal at the permittee's cost. Before issuing the permit, the Transportation Director may inspect the site, and the Fire Department, Fire Marshal, Police Department and Building Inspections Division are all authorized to check ongoing compliance. Design standards limit the dining area to the width of the restaurant's own frontage, require a clear pedestrian path of at least six feet (more where pedestrian traffic is heavy), and bar interference with utility poles, fire hydrants, parking meters, mailboxes, ADA accessibility routes and building ingress/egress. 120, and no vending machines, carts or sale items may be placed within the sidewalk dining area itself.
