Section 10.08.4245 requires a sidewalk dining permit for any tables, chairs, benches, umbrellas, or similar furniture placed in the public right-of-way, and restricts sidewalk dining to sidewalks within the Central Business District as delineated in Article 18 of Chapter 10.08. The DES Director or a designee issues the permit after confirming the standards are met, and applications proposing alcohol service are routed to the Chief of Police before approval.

Physical standards require a 4-foot unobstructed pedestrian clearance from any table, chair, umbrella or planter, plus a 2-foot clearance from the curb face. Furniture cannot block a doorway: the code mandates a clear zone extending 2 feet on each side of the door jambs and 8 feet straight out from a closed door. On corner lots, no dining furniture may sit within 10 feet of the corner curb line or crosswalk. Furniture must come off the sidewalk daily after business hours (fixed planters can stay), design must be compatible with the building's appearance, and hours of operation run 7:00 a.m. to 11:00 p.m.

Establishments serving alcohol face extra conditions: a barrier between 1 and 3 feet high separating the dining area from the rest of the sidewalk, posted signage warning patrons that drinks must stay inside the boundary, a capacity limit tied to approved seating, no bar setup, and a current Department of Alcoholic Beverage Control license, the loss of which automatically ends the City's permit for alcohol service. Permittees must carry $1,000,000 in commercial general liability coverage and indemnify the City.
