Notwithstanding any other provision of this Code, the following activity shall be permitted within the special event zone boundaries during a civic sponsored special event, provided that a limited duration license is first issued by the division of construction and business services:(1)The outdoor sale or distribution of any marketing or promotional items, merchandise, food, frozen food, flowers, or souvenirs from a fixed or mobile location on public or private property, except any of the described merchandise sold or distributed in the ordinary course of business by a retail establishment in continuous operation for more than thirty (30) days prior to the start of a licensed special event;

Sec. 986-201(a) permits outdoor sale or distribution of marketing items, merchandise, food, frozen food, flowers, or souvenirs from a fixed or mobile spot inside a special event zone during a civic sponsored special event only if the vendor first gets a limited duration license from the division of construction and business services, unless the vendor is a retailer that has sold that merchandise in the ordinary course of business for more than 30 days before the event. The same license covers temporary signage such as banners, A-frames, inflatables, and electronic message signs, temporary structures like tents and canopies, use of a previously vacant storefront, and temporary transportation routes or taxi stands (Sec.
986-201(a)). For a licensed special event that is not civic sponsored, Sec. 986-201(b) narrows the licensed activity to outdoor food sales, temporary transportation routes, and a single advertising banner near the event. The license fee is set under Sec. 131-501, though any vendor already holding a Title IV license continuously for more than 90 days is exempt from that fee (Sec. 986-202). Licensed vendor facilities cannot sit within 15 feet of a building entrance or bus loading zone, 100 feet of a competing retailer's entrance selling like goods, 10 feet of a sidewalk elevator, 6 feet of a sidewalk grate or fire hydrant, or 5 feet of a taxi stand, bus stop, crosswalk, driveway, or access ramp, unless the license administrator grants a written variance (Sec.
986-204). A limited duration license is valid up to 60 days for a civic sponsored event and 30 days for other special events (Sec. 986-204(f)).
Violations & Fines
Selling or distributing merchandise at a licensed special event without the required limited duration license, or without displaying it, is punishable under Sec. 103-3, and Sec. 986-401 lets police or business-services inspectors immediately seize and impound any merchandise tied to unlicensed activity, whether or not the seller holds any license at all. Failing to display an issued license is a separate daily offense under Sec. 986-208 and can also trigger suspension or revocation under Chapter 801.
