Land Development Code § 45-135 defines a special event sale as a temporary sale held in conjunction with a sporting event, parade, festival or other such event, and requires a temporary use permit for it, with the permit's duration capped at whatever period the county approved for the associated special event itself. That permit is issued under the general temporary use procedure in § 45-123, administered by the director of planning and development services: the applicant submits a site plan showing the use's location, access, parking and any signage, an affidavit of owner permission if the applicant is not the owner, a copy of the recorded deed, and the applicable fee.

The director may require review by other county or state agencies to protect public health, safety and welfare, with particular attention to traffic flow and pedestrian safety, and may attach conditions or deny the permit if no condition can ensure public safety. Temporary-use signage tied to the event is capped at two signs per property, no larger than 24 square feet each, under § 45-124, and must come down when the permit expires. Any final decision by the director can be appealed to the zoning board of adjustment under article XII of the Land Development Code.
