Idaho Animal Cruelty Statute Covers Hoarding Conduct

Idaho Code Title 25, Chapter 35 sets uniform statewide standards for animal care. Section 25-3504 makes it unlawful to be cruel to any animal or to cause an animal to be cruelly treated, including failing to provide necessary sustenance and shelter. Section 25-3520A sets escalating misdemeanor penalties, and a third conviction within fifteen years is a felony. Law enforcement and animal control officers may seize cruelly treated animals subject to procedural safeguards. Although cities and counties may adopt additional welfare ordinances, the state cruelty floor applies universally and cannot be reduced by local action.

First and second cruelty offenses are misdemeanors with fines and jail; a third offense within fifteen years is a felony under Section 25-3520A, with possible forfeiture of animals.
