Iowa Statewide Ban on Local Rent Control

Iowa law expressly forbids municipal rent regulation. Section 364.3(9) bars cities from passing any ordinance that imposes a limitation on the amount of rent that may be charged for leasing private residential or commercial property. Section 331.304(11) extends the same prohibition to counties. The statute does not distinguish between rent caps, rent stabilization, vacancy controls, or rent freezes. Landlords may set initial rent and adjust rent at lease renewal at any amount the market will bear, subject only to lease terms, fair housing law, and notice requirements in Iowa Code Chapter 562A.

Any city or county ordinance attempting to cap residential or commercial rent is void. Tenants or landlords harmed by an unlawful local rent ordinance may seek declaratory judgment and injunctive relief.
