Kansas Food Truck License Rules (Mobile Food Units)

K.S.A. 65-689(a) requires anyone conducting a food establishment to hold a valid license issued by the secretary of agriculture, and K.S.A. 65-656 pulls mobile units squarely into that definition: a food truck housed in a trailer is treated as a food establishment with its own location, as is the equipment of a unit not in a trailer. The Kansas Department of Agriculture Food Safety and Lodging program issues the license after an inspection. Under K.S.A. 65-688 the secretary sets a graduated fee schedule capped at a $350 application fee, with the food establishment annual license running $250 to $750 based on square footage. The license must be displayed conspicuously in the unit.

Operating a mobile food unit without a valid Kansas food establishment license is unlawful under K.S.A. 65-689(a). The secretary of agriculture may ask a district court for a temporary or permanent injunction to shut down a violator under K.S.A. 65-658, and licenses can be denied or pulled for failing inspection.
