Maryland Erosion and Sediment Control Statewide Requirements

Under MD Environment 4-103, no person may engage in earth-disturbing activity affecting 5,000 square feet or 100 cubic yards or more without an approved erosion and sediment control plan. Plans are reviewed by local soil conservation districts using the 2011 Maryland Standards and Specifications for Soil Erosion and Sediment Control. Construction sites require silt fences, stabilized entrances, sediment basins, and prompt stabilization. Inspectors are state-certified Responsible Personnel. MDE may issue stop-work orders, civil penalties, and require restoration for violations.

Earth disturbance without approved plans incurs civil penalties up to $10,000 per day, stop-work orders, and mandatory restoration of damaged waterways.
