Minnesota DNR Open Burning Permit Requirements

Under Minn. Stat. 88.16-88.22, open burning of vegetative debris generally requires a permit issued by the Minnesota DNR or local fire warden when at least three inches of snow does not cover the ground. Minn. Stat. 88.171 prohibits burning oils, rubber, plastics, chemically treated materials, garbage, or animal waste anywhere in the state. The DNR maintains a daily statewide burning restriction map; permits become invalid during high fire danger. Violations are misdemeanors and burners are civilly liable for fire suppression costs. These rules apply uniformly across Minnesota; cities may add restrictions but cannot waive state burning bans.

Open burning without required permit or burning prohibited materials is a misdemeanor with fines up to $1,000. Burners are also liable for full fire suppression costs and damages.
