Minnesota Pool Barrier and Fencing Standards

Minnesota Rules Chapter 1303 adopts the International Swimming Pool and Spa Code, which mandates barriers at least 48 inches high around outdoor residential pools holding more than 24 inches of water. Openings must not allow a 4-inch sphere to pass through, gates must be self-closing and self-latching with the latch at least 54 inches above ground, and any door from a dwelling into the pool area requires an alarm or lockable safety cover. Public pools follow stricter Minnesota Department of Health standards in Minn. R. 4717.1750 requiring 6-foot enclosures. Local jurisdictions may require taller fences but never lower.

Pools without compliant barriers may be ordered drained or fenced. Failure to comply can trigger code citations, daily penalties, and civil liability if injury occurs.
