Nebraska Consumer Fireworks Sale and Use Law

Under Neb. Rev. Stat. sections 28-1241 through 28-1252, only fireworks meeting the state's definition of 'permissible articles' may be sold to consumers, and retail sale is limited to June 25 through July 4 and December 28 through January 1. Bottle rockets, sky rockets, and similar aerial devices are banned for consumer use statewide. The State Fire Marshal licenses retailers, jobbers, and display operators. Municipalities may further restrict or prohibit consumer fireworks within their jurisdictions, but cannot authorize fireworks the state has classified as illegal. Public displays require a separately licensed operator and approved site plan filed with the Fire Marshal.

Class III misdemeanor for unlawful sale or possession; license revocation. Fines up to $500 plus up to three months imprisonment per offense.
