Nevada Tobacco Flavor Ban Status Under State Law

Unlike California or Massachusetts, Nevada has not enacted a statewide ban on flavored tobacco, menthol cigarettes, or flavored vapor products. NRS Chapter 370 governs tobacco licensing and taxation but does not restrict flavors. Federal FDA premarket authorization requirements apply to vapor products. Some Nevada local governments have considered flavor restrictions, but state preemption questions for tobacco regulation remain less defined than firearms preemption. Retailers must still comply with age, licensing, and tax obligations regardless of flavor.
