New Mexico Exotic Pet and Wildlife Possession Rules

Under NMSA 77-18-1, possession of subhuman primates, skunks, raccoons, foxes, and other sylvatic carnivores as pets is regulated by the Department of Health and Environment Department for public health and safety. NMAC 19.35.7 establishes four importation groups administered by Game and Fish. Group I covers semi-domesticated animals not requiring permits. Group II covers low-risk non-domesticated species. Group III requires permits with specific conditions. Group IV, including servals, ocelots, crocodilians, and venomous snakes, is prohibited for general public possession. Permits may be granted only for scientific study, zoological display, restoration, or qualified expert handling. Local ordinances may impose additional restrictions but cannot loosen state prohibitions.

Possessing a Group IV animal without authorization is a misdemeanor punishable by up to 364 days in jail and a $1,000 fine, plus animal forfeiture.
