Oklahoma Sets Statewide 1000-Foot School Buffer for Dispensaries

Under 63 O.S. Section 425 and OMMA rules, no medical marijuana dispensary may be located within 1,000 feet of any public or private school entrance, measured by the most direct accessible route. The Unity Bill expressly authorizes municipalities to regulate dispensaries like other retail businesses through zoning, conditional use permits, and standard business licensing. However, cities cannot ban dispensaries entirely, charge license fees beyond standard rates, or shorten the 1,000-foot school setback. Some communities add buffers from churches, daycares, or other dispensaries. Dispensaries must also hold a valid OMMA business license before opening.

Operating within 1,000 feet of a school, or without an OMMA license, can result in license revocation, civil penalties, and criminal charges for unlicensed cannabis activity.
