South Dakota state law: consumer fireworks legal statewide; cities and counties may restrict

South Dakota's fireworks framework is governed by SDCL Chapter 34-37 (Fireworks). Consumer fireworks meaning 'permissible fireworks' as defined in 34-37-1 (American Pyrotechnics Association Standard 87-1 / 1.4G classification — including aerial shells, multiple-tube/cake devices, sparklers, fountains, cones, ground spinners, Roman candles, bottle rockets, and firecrackers) are legal for sale and personal use during the statutory seasonal windows traditionally running June 27 through July 5 (summer / Independence Day) and December 28 through January 1 (winter / New Year). SDCL §34-37-2.1 makes it a Class 2 misdemeanor to sell, give, or dispense fireworks to a person under the age of eighteen. SDCL §34-37-19 (Power of board of county commissioners to restrict fireworks and other fire-causing activities) authorizes county commissioners to adopt an ordinance restricting or prohibiting fireworks tied to the South Dakota Grassland Fire Danger Index — violation is a Class 2 misdemeanor. SDCL §34-37-16.1 authorizes the South Dakota Wildland Fire Division (within DANR) to impose a statewide ban on certain activities, including fireworks, when fire conditions warrant. Municipalities retain authority under SDCL §9-29-1 to prohibit discharge of fireworks within city limits — both Sioux Falls (Code §96.005) and Rapid City (Code §8.20) prohibit discharge inside city limits despite the statewide consumer legalization, leaving discharge legal mostly in unincorporated rural areas during the statutory windows.

Sale of fireworks to minors under 18 is a Class 2 misdemeanor under SDCL §34-37-2.1, punishable by up to 30 days in county jail and/or a $500 fine. Violation of a county fireworks-restriction ordinance is a Class 2 misdemeanor under SDCL §34-37-19. Possession or use of unauthorized (display-grade / 1.3G) fireworks without a license is a misdemeanor under SDCL §34-37 generally. Municipal discharge bans are enforced as Class 2 misdemeanors or local infractions under SDCL §9-19-3. A statewide DANR suspension under §34-37-16.1 carries criminal liability for violations.
