South Dakota state law: overnight parking and snow-emergency restrictions

South Dakota state vehicle law (SDCL Title 32) does NOT impose a uniform statewide rule prohibiting overnight on-street parking. The statewide baseline is set by SDCL Chapter 32-30 (Stopping and Parking) — which prohibits parking on sidewalks, in intersections, on crosswalks, within posted distances of hydrants and driveways, and in any signed restricted zone — and by SDCL 32-30-12, which presumes a vehicle abandoned after 24 hours on a public way. Beyond this floor, overnight parking rules are set entirely by municipal ordinance under SDCL 9-29-1 (statutory cities — Dillon's-Rule general welfare clause) and SDCL Chapter 6-12 (Sioux Falls, Rapid City, and Watertown home-rule charters). Because South Dakota experiences heavy seasonal snowfall, virtually every South Dakota municipality of any size operates a snow-emergency parking ordinance authorizing the mayor or city engineer to declare a snow alert, prohibit on-street parking on designated snow routes during the alert (typically until the streets are cleared curb-to-curb), and tow violators. SDCL 32-30-12.1 expressly authorizes municipalities to 'modify or change provisions of [the abandoned vehicle statutes] to meet its needs or clarify the duties of its peace officers' — the textual hook for shorter or longer on-street parking windows than the state-default 24 hours. Outside snow-emergency hours, year-round overnight on-street parking limits, alternate-side rules, and residential permit zones are also set entirely by municipal ordinance. Per SDCL 32-30-12, a vehicle that exceeds the time limit may be towed and processed for abandoned-vehicle disposition.

Snow-emergency parking violations: municipal fines typically $25-$100 per offense, with the vehicle towed at the owner's expense (typically $150-$300 plus storage). Year-round overnight parking violations are enforced by the local police or Parking Enforcement Office under the municipal parking ordinance schedule. Vehicles exceeding 24 hours on a public way (or any shorter municipal-ordinance period) may be processed as abandoned under SDCL 32-30-12.
