West Virginia Mobile Food Establishment Permits and Inspection

Every mobile food establishment in West Virginia must obtain a permit from a local health department under Bureau for Public Health food-establishment rules (64 CSR 17, based on the FDA Food Code), demonstrating an approved commissary, water, and waste system and passing a sanitation inspection. W. Va. Code §16-2-18 requires a local or county health department to issue a mobile food establishment reciprocity permit to an operator already permitted by another West Virginia health department, at no additional fee, with at least 72 hours' notice before operating in the new jurisdiction. Local zoning still controls where trucks may park or vend.

Operating without a permit is a misdemeanor punishable by fines and immediate closure. Permits may be suspended or revoked for sanitation violations or imminent health hazards.
