Under SB 946 and Irvine Municipal Code Chapter 14, the city distinguishes between roaming vendors (who move from place to place) and stationary vendors (who vend from a fixed location). Roaming vendors cannot be prohibited from operating in public parks or residential areas. Stationary vendors may be restricted within parks that have an existing exclusive food concession agreement, or within 500 feet of a certified farmers market during its operating hours. The city may establish additional location restrictions only if they are directly related to objective health, safety, or welfare concerns, supported by evidence in the administrative record. Vendors must not obstruct pedestrian or vehicle traffic, block accessibility ramps, or impede emergency access. Vending within the public right-of-way must maintain minimum ADA-compliant clear passage widths. The Irvine Spectrum, University Town Center, and other commercial areas managed by private property owners may have separate restrictions imposed by the property owner rather than the city.
