Davie treats above-ground pools like other pool construction: a building permit is required from the Town of Davie Building Division, and the work is governed by the Florida Building Code adopted in Town Code Sec. 5-1 (as amended by the Broward County Administrative Chapter). Under the Florida Building Code, Residential, Section R4501.17, where an above-ground pool's structure serves as the barrier, the barrier must still meet the 48-inch minimum height measured from the adjacent grade, and any ladder or steps must be capable of being secured, locked, or removed, or be surrounded by a complying barrier when the pool is not in use, so a child cannot climb in.
