Davie's own pool-safety ordinance, Code Sec. 5-66, declares that swimming pools containing stagnant water are 'unsanitary and dangerous to human life' and are deemed unsafe. Beyond that, residential pool safety features (barriers, alarms, covers) are set by the state Residential Swimming Pool Safety Act, Fla. Stat. Ch. 515, which Davie references.
Under Town of Davie Code Sec. 5-66 (Unsafe buildings as defined by the Florida Building Code), the Town lists conditions that make a structure unsafe and specifically provides: 'Swimming pools that contain stagnant water are deemed unsanitary and dangerous to human life and public welfare and shall be presumed and deemed unsafe.' That gives Davie Code Compliance and the Building Division authority to abate green, abandoned, or neglected pools as unsafe structures. For the protective safety features that prevent drownings, Davie defers to state law: its Water Safety Initiatives page directs residents to 'Florida Building Code 454.1.3.1.9' and 'Florida Statute 515.27,' the Residential Swimming Pool Safety Act. Under Fla. Stat. 515.27, a residential pool must be equipped with at least one approved safety feature before a certificate of completion is issued - an isolating barrier meeting Ch. 515, an approved safety cover (ASTM F1346), exit alarms or self-latching/self-closing devices on all doors and windows with direct pool access, or a pool alarm. The Town also promotes door alarms and drowning-prevention resources (Water Smart Broward) and operates an Aquatics Division (954-327-3926). These state-set features, plus the local stagnant-water rule, are the safety framework that applies to Davie pools.
A pool with stagnant water is 'deemed unsafe' under Davie Code Sec. 5-66 and can be cited and abated as an unsafe structure by the Building Division / Code Compliance. Operating a residential pool without a required state safety feature violates Chapter 515, Florida Statutes (a second-degree misdemeanor under Fla. Stat. 515.27).
