Davie does not set its own pool-fence height. Because the Town adopted the Florida Building Code (Code Sec. 5-1), residential pool barriers follow the state standard in FBC-R Chapter 45 (R4501.17) and the Residential Swimming Pool Safety Act (Fla. Stat. Ch. 515): a barrier at least 48 inches high with no gaps or footholds.
Town of Davie enforces the Florida Building Code as adopted by Code Sec. 5-1 and amended by the Broward County Administrative Chapter, so the pool-barrier requirements are the statewide ones rather than a separate Davie fence ordinance. Under the Florida Building Code, Residential, Section R4501.17, an outdoor residential pool must be enclosed by a barrier with the top at least 48 inches (4 feet) above grade on the side facing away from the pool, with no gaps, openings, or footholds that would let a young child crawl under, squeeze through, or climb over. A standard screen enclosure meeting R4501.17 may serve as part or all of the barrier. The Town's Water Safety Initiatives page expressly points residents to 'Florida Building Code 454.1.3.1.9' and 'Florida Statute 515.27,' confirming Davie defers to those state rules for barriers and safety features. Florida's Residential Swimming Pool Safety Act (Fla. Stat. 515.27) additionally requires at least one approved safety feature - an isolating barrier, an approved safety cover, exit alarms or self-latching/self-closing devices on doors with direct pool access, or a pool alarm. The barrier is verified at the building-permit safety inspection handled by the Davie Building Division.
Failing to install a complying pool barrier is a violation of the Florida Building Code (adopted by Davie Code Sec. 5-1) and Chapter 515, Florida Statutes; under Fla. Stat. 515.27 the absence of a required safety feature is a second-degree misdemeanor. Davie's Building Division and Code Compliance enforce the barrier at inspection and on complaint.
