Under N.J.A.C. 5:23 and the International Swimming Pool and Spa Code, above-ground pools capable of holding water more than 24 inches deep require a construction permit and must comply with barrier rules. Where the pool wall is at least 48 inches high, it may serve as a barrier provided ladders are removable or capable of being secured. Decks attached to above-ground pools generally require their own permit and must meet barrier and guard requirements adopted statewide.
Installing an above-ground pool without permits or required barrier protection can trigger UCC enforcement, daily fines, and orders to remove the pool until compliance is achieved.
