Edison Township enforces ongoing pool safety and sanitation standards through Chapter 17 (Housing) Β§17.08.170, supported by the New Jersey Department of Health's Public Recreational Bathing rules at N.J.A.C. 8:26. The annual pool license renewal (expiring April 30) is conditioned on Health Officer inspection of water clarity, chlorination/sanitizer residual, pH balance, equipment condition (pumps, filters, anti-entrapment drain covers), and the integrity of the barrier and gate hardware. Pool water that becomes stagnant or unsanitary is a public health nuisance and may trigger an order to drain and re-treat the pool. Mosquito and vector control is required - standing water on or around the pool deck cannot be allowed to support mosquito breeding, and pools left unused must be either drained or maintained with continuous filtration. Anti-entrapment drain covers compliant with the federal Virginia Graeme Baker Pool and Spa Safety Act (15 U.S.C. Β§8001 et seq.) are required for all pool main drains; this federal requirement is enforced by the Edison Construction Code Official at inspection. Pools serving an HOA, condominium, club, or any non-household audience are 'public recreational bathing places' under N.J.A.C. 8:26 and must additionally comply with the state's lifeguard, signage, depth-marking, and bacteriological water-testing requirements administered through the Middlesex County Office of Health Services. Diving boards, slides, and pool heaters add electrical, plumbing, and fire-protection inspection items to the UCC review.
Failure to maintain sanitary water, control mosquitoes, or install compliant anti-entrapment drain covers can trigger a Health Officer order to close the pool, license suspension, and daily fines under the Township general penalty schedule. Operating an unlicensed public bathing place subjects the operator to enforcement by the NJ Department of Health and the Middlesex County Office of Health Services in addition to Township penalties.
