Under the fencing rule (Sec. 22-21(a)), an above-ground pool with a wall greater than 4 feet in height does not require a separate fence if the wall cannot be readily climbed by children, meaning the pool wall itself can serve as the barrier. Where a deck, ladder, or stairway provides access, that access point must have the self-closing, self-latching gate. All setback, drainage, electrical, filtration, and life-saving requirements of Chapter 22 still apply. The city's notarized Swimming Pool Fencing Agreement notes the same 4-foot wall exception. Installation must also meet the Minnesota State Building Code.
Installing an above-ground pool without a permit, or leaving an access ladder or stairway without a self-closing, self-latching gate, is unlawful and subject to administrative or court citation.
