Every private pool in Woodbury must be completely surrounded by a fence or wall at least 4 feet high, with no openings, holes, or gaps larger than 4 inches, and built so it can't be readily climbed by children. Gates must be self-closing, self-latching, lockable, and kept locked when the pool is not in use.
Woodbury City Code Sec. 22-21 requires that all private swimming pools be completely surrounded by a fence or wall not less than 4 feet in height, constructed so it has no openings, holes, or gaps larger than 4 inches in either the vertical or horizontal direction (except for doors and gates). The fence must be of a type not readily climbed by children. A dwelling or accessory building may form part of the enclosure. All gates or doors opening through the enclosure must be equipped with a self-closing and self-latching device that keeps them securely closed when not in use, and must have hardware for permanent locking devices, except that the door of a dwelling forming part of the enclosure need not be so equipped. Pool gates must be locked when the pool is not in use. If the pool must be filled before the permanent fence is installed, a temporary fence such as a snow fence may be installed in a substantial manner with the building official's approval, for a maximum of 30 days (Sec. 22-21(c)). Fences must also comply with the city's general fence ordinance, Chapter 6, Article IV. The city requires a notarized Swimming Pool Fencing Agreement, and a pool cover is not acceptable in lieu of a fence. The city council may modify these requirements for good cause if protection is not reduced (Sec. 22-19).
An unfenced or non-compliant pool enclosure is grounds for an administrative citation; continued non-compliance can result in a court citation. A pool cover is expressly not accepted in place of the required fence.
