All public and private swimming pool installations must be complete, completely filled with water and in operation before final inspection. For the safety of others, before final inspection, the pool shall be completely enclosed with a wall, fence or other substantial structure not less than four (4) feet in height and with maximum two (2) inch mesh or two (2) inch vertical openings, or otherwise constructed as to be difficult to climb.

This construction-stage barrier applies to public and private pools alike and is separate from the ongoing 48-inch maintenance barrier in § 21-131. Separately, under § 33-58, plans for public or semipublic pool construction must be approved by the Chattanooga-Hamilton County Health Department before any other city permit issues; private residential pools are excepted from that Division 2 health-department review.
