CBMC § 17.02.065 amends IPMC Section 303.2 so that any private pool, hot tub or spa deeper than 24 inches must have a barrier meeting the standards of the city's adopted International Swimming Pool and Spa Code, codified at CBMC § 13.27.010, which the city council adopted in the 2018 edition and applies to the erection, installation, alteration and maintenance of swimming pool, spa and hot tub systems within Council Bluffs. CBMC § 13.27.015 replaces the ISPSC's own administrative chapter with the enforcement structure in CBMC § 13.01, so the Building Official administers pool-barrier compliance the same way as other adopted construction codes, including plan review and permit issuance before a pool or its enclosure is installed.

Once a compliant enclosure is in place, § 17.02.065 bars an owner from removing, replacing or altering the barrier in any manner that reduces its effectiveness as a safety barrier, a standalone maintenance duty that runs for as long as the pool exists, independent of any permit history. Related plumbing provisions in the same chapter, CBMC §§ 13.27.020 through 13.27.040, require pool piping, backflow protection and wastewater discharge to meet the adopted plumbing code, underscoring that the pool code functions as a full regulatory scheme rather than a single barrier rule.

The Building Official may inspect rental and owner-occupied properties alike under CBMC § 17.09.010 to verify a pool enclosure remains compliant, and a noncompliant enclosure can support a notice of violation under the Title 17 enforcement chapter.
