Fort Bend County's pool regulations require regulated pools to be enclosed with a barrier that prevents unauthorized access. Barriers must be at least 48 inches in height, constructed of rigid material, with vertical openings spaced so a 4-inch sphere cannot pass through. Gates must be self-closing and self-latching with the latch positioned out of reach of small children. Doors with direct pool access from a building must also have self-closing, self-latching mechanisms. These county standards layer on top of Texas Health and Safety Code Chapter 757 statewide pool yard enclosure law.
Inadequate or damaged fencing, missing self-latching gates, or barriers below 48 inches can result in failed inspection, permit suspension, and Class C misdemeanor citations under both county regulation and state law.
